Client Requirements for I-956 Regional Center Applications

Construction and Development Budget: Separate Hard costs; Soft costs; Land acquisition costs.

Pro-forma Financial Statements: Forecasted Gross Revenues from the project(s) and/or the number of direct employees to be hired.

The Timing of all Phases: Calendar Year.

Ongoing operations: Segment current expenditures and/or jobs from any future expenditures and/or jobs to be created. Current operations cannot be counted.

EB-5 Job Creation Studies (IMPLAN & RIMS II)

Scope of Work

Compile most recent available demographic and economic information for the relevant economic area in the State of State Name.

Assign project annual development expenditures, operating revenues and employment to pertinent industry sectors in the regional models, based on definitions of the North American Industry Classification System (NAICS).

Build regional models for the relevant economic area using the Impact Analysis for Planning (IMPLAN) and/or RIMS II, including multipliers for indirect/induced effects arising from industry supply chain activity, spending by employee households, local/state and federal governments, and capital investment.

Estimate share of expenditures made in the state or local area, and share of revenues originating from outside the local area or state, for each proposed business activity (if applicable for regional analysis).

Estimate regional economic impacts of the proposed project in the county and state, including employment (full-time and part-time jobs), output (revenue), value added, labor income, property income, and indirect business taxes to governments.

Determine number of potential investors supported by the project based on investment and job creation guidelines for USCIS Regional Centers in Targeted Employment Areas, if applicable.

Write report on study findings (see contents described below) and submit to the client as an electronic document (pdf).

Provide oral consultation to the client to explain study methods, findings and conclusions (upon request).

EB-5 Job Creation Feasibility Analysis (IMPLAN & RIMS II)

Barnhart Economic Services, LLC can conduct an economic job creation analysis to determine if your project(s) generates sufficient jobs to be financially feasible.

This will determine whether the project will create enough jobs to obtain the EB-5 capital needed. Just as in the full job creation study, a unique, multi-county economic model is built for your specific location.

Targeted Employment Area (TEA) Designation

Barnhart Economic Services, LLC has obtained the national, corrected Local Area Unemployment Statistics (LAUS) data set from the Bureau of Labor Statistics. Therefore, we can construct TEA’s for any area in the United States.

What Is a TEA Designation?

With the passage of the EB-5 Reform and Integrity Act of 2022 a TEA or Targeted Employment Area must now be adjudicated by USCIS. This implies that an EB-5 Economist must analyze the data and submit the findings to USCIS.

Targeted Employment Areas (TEA) and Rural Areas

Targeted Employment Area: The Reform Act defines a TEA as the project census tract and any directly adjacent census tracts with a weighted average unemployment rate of at least 150 percent of the national average rate or it must be a Rural Area.

The Area may include a geographic area or subdivision within an MSA, a city, or town, i.e., can be as small as a single census tract.

Rural Area: any area outside an MSA and outside the boundary of any city or town having a population of 20,000 or more.

What if my Census Tract is not a TEA?

We can construct a TEA using Census Tract data. However, it is necessary that surrounding areas have high unemployment rates while also having a large labor force.

Surrounding Census Tracts with high unemployment but low numbers in the labor force will not help as these calculations are weighted averages.

What are the main types of goods or services to be offered in the projects?
For example, in the case of a commercial real estate venture, there may be construction and then several different types of businesses that would occupy the commercial space, such as retail, resorts, hotels, health spas, etc. This information is crucial to determine the specific North American Industry Classification System (NAICS) code(s) that are used in regional economic models.

If construction involved,
how long this will take?

Will the project(s) be done in phases, e.g., a first building to be opened two years from now, a second to open four years from now, etc. Where will the principal production/operation facilities and management offices be located (city, county, state)?

Finally, the actual or planned income, expenditures, and employment of individuals in all phases of the project(s) are needed.

Pro-forma income statements are very useful in this regard.
